By accepting these Terms of Service, you represent that you are of legal age in your state or province of residence and that you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase, or operate.
To use the Services, including accessing or browsing our online stores or purchasing any
products or services we offer, you may be asked to provide certain information, such as your email address and billing, payment, and shipping information. You represent and warrant that all information you provide in our store is accurate, current, and complete, and that you have all rights necessary to provide such information.
You are solely responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You may not transfer, sell, assign, or license your account to any third party.
SECTION 2 - OUR SERVICES
We have made every effort to provide an accurate representation of our services on our online site. However, please note that the colors or appearance of rooms and locations may differ from how they appear on your screen due to the type of device used to access the store and your device settings and configurations.
We do not guarantee that the appearance or quality of any service purchased will meet your expectations or match that depicted or displayed in our online stores.
All service descriptions are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any service at any time and may limit the quantities of any service offered to any person, geographic area, or jurisdiction on a case-by-case basis.
Services included:
The services included in the price are: overnight stay and breakfast.
Breakfast is served in the restaurant from 8:00 to 9:30, with exceptions of which we will be sure to inform guests.
Food, including outside food, is permitted in the facility, provided that it complies with the rules of civil coexistence in the common area or in the room itself.
Rooms are equipped with a TV, mini-fridge, air conditioning, free Wi-Fi, hairdryer, courtesy kit, and bathroom linens. Except in exceptional circumstances, housekeeping takes place every morning from 10:00 to 12:00 (if the room is vacant). Bathroom linens are changed every 3 days, and bed linens every 5 days, as required by regional regulations. Should guests request a different service, linen change services are available for a fee; the price list is located in the desk drawer of each room.
Services not included:
The restaurant, open every day for dinner except Tuesdays, is considered an extra service, not included in the cost of the overnight stay. Extra services such as dinner are payable at the time of request and use, e.g., dinner at the end of the dinner.
Other services:
Free parking: large private parking lot, fenced but not gated.
Reading corner.
Shared kitchenette.
Pets allowed.
Garden with outdoor play area.
Fire extinguisher.
Invoice available upon request.
Large private bathroom.
Clothesline.
Maximum occupancy or guests per room:
Rooms have a set capacity that cannot be exceeded. The overnight rate includes the tourist tax and breakfast, and also applies to children and adolescents.
For overnight stays with a child aged 0 to 3 years, the cost of a crib is €10 per night.
There is no charge for children aged 0 to 3 years if a crib is not requested and if a double room is booked.
For example: if you book a double room and the child sleeps in the twin bed, you pay nothing in addition to the price of the double room.
If you book a double room with an additional crib, you will pay an additional €30 per night.
Pets
Pets are allowed and have an additional cost of €10 per night.
Security and Valuables
We advise guests not to leave valuables unattended in their rooms, as the property will not be responsible for any theft or loss.
SECTION 3 - RESERVATIONS AND CANCELLATIONS
When you make a reservation, you are making an offer to purchase. Il Magnolia - Ristorante, Pizzeria, and Guesthouse in Francavilla al Mare reserves the right to accept or decline your order for any reason, at its sole discretion. Your reservation is not accepted until Il Magnolia - Ristorante, Pizzeria, and Guesthouse in Francavilla al Mare confirms acceptance. Payment must be received and processed before your order will be accepted. If your order is not accepted, modified, or canceled, we will attempt to notify you by contacting the email address, billing address, and/or phone number provided at the time of ordering.
Reservations:
Reservations can be made in the following ways:
By purchasing on the website il-magnolia.com or by calling +393289780366.
When you book online, you will pay the full amount.
Cancellations:
- The amount is refundable if the cancellation occurs more than 7 days before the first night's stay.
- If the cancellation occurs within 7 days of the first night's stay, 30% will be retained and 70% will be refunded.
- If you have booked and do not show up, the full amount of the reservation will be retained to cover the damage caused by the lack of notice.
- The reservation is valid after receiving the payment confirmation email.
Example:
You booked on March 1st for a stay from June 7th to 14th for a total of €1,000.
If you cancel your reservation between March 1st and midnight on May 30th, we will refund 100% (€1,000).
If you cancel your reservation between midnight on May 30th and midnight on June 6th, we will refund 70% (€700).
If you do not show up on June 7th, you will not receive a refund.
In case of early departure:
In case of early departure, the guest will lose the full amount paid. No refund will be given for any unused nights for which payment has already been made and the invoice has already been issued.
Reservation changes:
Reservations can only be changed based on property availability. The price remains unchanged if you book the same room type and if the booking period is for the same price. Otherwise, you will be required to stay within the booking period and pay a surcharge (if applicable) or receive a refund for the excess. We will inform you of any applicable payment methods for the surcharge.
SECTION 4 – PRICES AND BILLING
Prices, discounts, and promotions are subject to change without notice. The price charged for a service will be the price in effect at the time the order is placed and will be indicated in the order confirmation email. Unless otherwise expressly stated, published prices include taxes and handling fees.
Prices published in our online stores may differ from prices offered in physical stores, online stores, or other stores operated by third parties. We may, from time to time, offer promotions on the Services that may affect prices and which are governed by terms and conditions separate from these Terms. In the event of a conflict between the terms of a promotion and these Terms, the terms of the promotion will prevail.
You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases made in our stores. You agree to promptly update your account and other information, including your email address, credit card numbers, and expiration dates, so that we can complete your transactions and contact you as needed.
You represent and warrant that (i) the credit card information you provide is true, accurate, and complete, (ii) you are duly authorized to use such credit card for the purchase, and (iii) any charges incurred will be honored by the company.

SECTION 5 - PROPERTY RULES
Check-in and Check-out
Check-in is 2:00 PM - 11:00 PM. If checking in after 11:00 PM, guests are requested to contact the property and provide their estimated arrival time, and in any case, notify the property at least 30 minutes before their arrival outside of these hours. If arriving very late at night, please notify the property well in advance, as the property does not have a night concierge service.
Check-out is NO LATER than 10:00 AM on the morning of departure, as the staff takes care of cleaning and preparing the rooms for subsequent check-ins of the day from 10:00 AM to 12:00 PM.
Late check-outs will incur a €10 penalty for each hour of unauthorized stay.
You can leave your luggage in our safekeeping for free and pick it up during the day at an agreed-upon time.
Identification documents are required for all guests, including minors, for public safety reasons.
What not to do
Smoking is prohibited in all internal areas of the property, including the B&B's common area. After midnight, guests are required to observe the rules of silence in the common areas and in the rooms. Out of respect for other guests, fires and open flames are prohibited in the rooms and throughout the property.
SECTION 6 - INTELLECTUAL PROPERTY
Our Services, including, but not limited to, all trademarks, branding, text, display elements, images, graphics, product reviews, video, and audio, as well as the design, selection, and arrangement thereof, are the property of Il Magnolia - Ristorante pizzeria e affittacamere a Francavilla al Mare, its affiliates, or its licensors and are protected by U.S. and foreign patent, copyright, and other intellectual property laws.
These Terms permit you to use the Services solely for your personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any material from the Services without our prior written consent. SERVICES, EVEN IF THE POSSIBILITY OF SUCH DAMAGES HAS BEEN ADVISED.
SECTION 18 - INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Il Magnolia - Ristorante pizzeria e affittacamere a Francavilla al Mare, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any loss, damage, liability, or claim, including reasonable attorneys' fees, made by any third party or arising out of (1) your breach of these Terms of Service or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.

Damages will be assessed and settled based on the amount and payment method to be agreed upon.

In the event that any of any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service; such determination shall not affect the validity and enforceability of any other remaining provisions.
SECTION 20 - WAIVER; ENTIRE AGREEMENT
Our failure to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
